Terms of Service

Effective Date: April 7, 2026

1. Agreement to Terms

By accessing or using eLearningDesign.org (the “Site”), operated by Genovese Designs LLC, a Florida limited liability company, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Site or its services.

“Services” refers to all interactive HTML generators, tools, downloadable content, and related features available through the Site.

2. Eligibility

You must be at least 18 years of age to create an account or purchase a subscription. By using the Site, you represent that you meet this requirement.

3. Accounts and Membership

Certain features of the Site require you to create an account through our membership provider, Memberstack. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate, current information when creating your account and to update it as necessary.

4. Subscription Plans and Payments

The Site offers a free tier and paid subscription plans. Free tier users may access select generators with limited export functionality. Paid plans (including eLearningDesign Pro) unlock full access to premium generators and export features.

All payments are processed through Stripe. By subscribing, you authorize recurring charges at the rate displayed at the time of purchase. Prices are listed in U.S. dollars unless otherwise stated.

Subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless you cancel before the renewal date. You may cancel at any time through your account settings.

5. Refund Policy

Because our generators provide immediate access to digital tools and downloadable HTML output upon subscription, all sales are final. We do not offer refunds for partial billing periods or unused subscription time.

If you believe you were charged in error, please contact us and we will review your case.

6. Free Tier and Soft Gating

Free tier access allows limited use of select generators. HTML output from free tier generators includes a small attribution line crediting eLearningDesign.org. This attribution may not be removed unless you upgrade to a paid plan.

7. Use of Generated Content

When you use our generators, you retain ownership of the content you create (your text, images, and data). The HTML output generated by our tools is licensed to you for unlimited personal, educational, and commercial use within your own projects and courses.

You may NOT:

  • Resell, redistribute, or sublicense the generator tools themselves or their underlying code

  • Reverse-engineer, decompile, or extract source code from any generator

  • Offer the generators or their output as a competing product or service

  • Remove or alter the attribution line from free tier HTML output

8. Intellectual Property

All generator tools, designs, code, branding, and site content are the exclusive property of Genovese Designs LLC and are protected by U.S. copyright and intellectual property laws. Nothing in these Terms grants you ownership of or rights to any part of the Site or its tools beyond what is explicitly stated in Section 7.

9. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose

  • Attempt to gain unauthorized access to any part of the Site, other accounts, or connected systems

  • Use automated tools (bots, scrapers, crawlers) to access the Site without permission

  • Interfere with or disrupt the Site or its infrastructure

10. Third-Party Services

The Site integrates with third-party services including Memberstack (authentication and membership), Stripe (payment processing), Vercel (hosting), and Wix (website platform). Your use of these services is subject to their respective terms and privacy policies. Genovese Designs LLC is not responsible for the practices or availability of third-party providers.

11. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components. Generator output is provided for instructional design use and is not guaranteed to be compatible with every learning management system or platform.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, GENOVESE DESIGNS LLC, ITS OWNER, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES.

Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Genovese Designs LLC and its owner from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

15. Termination

We reserve the right to suspend or terminate your account and access to the Site at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Site, other users, or Genovese Designs LLC.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Florida.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Genovese Designs LLC regarding your use of the Site.
